The driver was crossing the double yellow which is illegal in the state of California and it was a hit and run(§ 20001) which is a fine of between 100 to 1,000 or a year in jail, sometimes both depending on the situation.
Here are the facts:
Car turns on its signal to exit the HOV/carpool lane. Despite the signal, this is still illegal because of the double yellow lines.
Motorcycle approaches from behind, lane splitting in between the 2 left-most lanes. The motorcycle collides with the car.
Considering the fact that this license plate is from California, as are the others in the video, we can assume that this accident occurred in that state. In this case, because of california state laws, the biker was lane splitting legally. He may have been driving at a faster speed than traffic, but he was not performing any illegal maneuvers.
Conclusion: all the evidence points to the car being at fault. Some people are saying the car also ran from the scene. I don't know if that's true; I couldn't tell from what I saw. If it did, that is enough reason for serious consequences.
Okay both were in the wrong. The motorcyclist shouldn’t have land split and he was going way to fast. The car used a turn signal but was crossing a double yellow. Lane splitting should be illegal in california
OK. Both the car and biker were in the wrong. The car driver split a double yellow line. The biker was lane splitting which is iLlEgAl and he was going too fast.
I think you should give this dude a break because the ford fusion driver probably didnt see the biker because he was so far back and he was going a little bit too fast and wasnt being careful.
The fusion driver I in fact DO forgive. I understand that he may not have seen the biker because he was very far back and was going a slight bit too fast. The fusion driver also used his blinker like there was nothing wrong for him to move over...but he/she did cross a double yellow line. Both are in the wrong in case you wanna give a crap about it.
I don't care what your opinion is because both were doing something strange.
If you want to reply, go ahead because I don't care. Just let it go. It happened over 1 year ago.
Car was in the wrong, AND the biker was in the wrong. Neither of them were driving defensively, and it's something the biker could have avoided by driving correctly. No one in this world is going to look out for you except yourself, and that biker definitely wasn't looking out for himself.
Internet Verdict: Car should be ticketed for crossing a double yellow line, Motorbike should be ticketed for unsafe driving and splitting the lane.
Don't give me that crap about "He needed to make himself seen by the other cars so he was riding to be in line with their mirrors..." because it sure didn't work in his favor if that's the case.
"Defensive driving" is not mandated by law. The biker broke no laws at all. The car crossed a solid double yellow lane marker which is very illegal, not to mention he fled the scene.
